1. Protos Mediterrane Spezialitäten enters into contractual relations with adult customers only with regard to the trade of alcoholic beverages and food products. For this reason, by submitting their order for alcoholic beverages and food products, customers assure that they are over 18 years of age. Furthermore, the customers assure that the information they provide regarding their age, name and address is correct. Furthermore, the customer is obliged to ensure that only he himself or persons of full age authorized by him to receive the delivery accept the delivery of goods.
2) As far as persons of less than 18 years of age place orders by stating false facts and/or without the approval of their responsible persons of age who are entitled to care or representation, Protos Mediterrane Spezialitäten hereby revokes these contracts in principle as a precautionary measure according to § 111 BGB.
3) If Protos Mediterrane Spezialitäten receives positive knowledge of an order that was placed under false information, especially age information, Protos Mediterrane Spezialitäten reserves the right to initiate criminal proceedings in addition to the above revocation in accordance with § 111 BGB.
The persons of legal age who are entitled to care for and/or represent minors and/or adolescents ordering under false information shall be liable to Protos Mediterrane Spezialitäten in accordance with the legal regulations of Protos Mediterrane Spezialitäten for all damages resulting from orders placed under false information. This includes the indemnification of Protos Mediterrane Spezialitäten from claims that Protos Mediterrane Spezialitäten arise from the obligation of the customer under point 1.
